Welcome to myconmigo.com (the "Site"), the website of Conmigo Collective LLC (hereinafter “Conmigo," "we" or "us"), a New Mexico limited liability company with service of process at Conmigo Collective LLC’s principal business address on file with us. Conmigo is a membership and community company that offers memberships, community access, content, communications, events, event interest lists, merchandise, collaborations, and related digital and in-person experiences (the “Site”). This policy (our “Privacy Policy”) is a legally binding agreement that explains how we collect, use, disclose, and protect information related to our Site and our online service (the “Service”), and describes your choices about the collection, use, and disclosure of your information. This Privacy Policy is intended to be read together with our Terms of Use, any membership terms, event terms, waivers, checkout terms, and any additional notices we provide at the point of collection. For dispute resolution, we utilize the forum and procedures specified in our Terms of Use. By accessing or using the Site or the Service, you warrant and represent that you have read, understood, and agree to be bound by, this Privacy Policy and the Terms of Use, which incorporate by reference this Privacy Policy. If you do not wish to be bound by this Privacy Policy, you should not access or use this Site or the Service. Capitalized terms that are not defined in this Privacy Policy have the meanings given to them in the Terms of Use.

Your Rights

Depending on where you live and subject to applicable law, you may have the right to request access to personal information we hold about you, request correction of inaccurate information, request deletion of personal information, request a portable copy of certain personal information, withdraw consent where processing is based on consent, and object to or limit certain processing activities, such as some direct marketing uses. We will respond to your request in accordance with applicable laws, regulations, and requirements, where technically feasible. While we strive to honor all user rights requests, please note that there may be limitations or exceptions based on legal requirements, legitimate business interests, security concerns, fraud-prevention needs, or technical constraints. 1. HOW WE COLLECT AND USE INFORMATION ABOUT YOU

Information our members, prospective members, users, customers, and event participants provide us directly:

We ask for certain information from current and former members, prospective members, users, customers, collaborators, and event participants seeking memberships, community access, event participation, purchases, newsletters, updates, or related services (“Users”), such as name, email address, phone number, mailing address, billing address, username, account credentials, order details, event registration information, membership tier selections, communication preferences, social media handles if you choose to provide them, and other identifiers or information you submit through forms, checkout pages, applications, surveys, waitlists, or communications with us. For certain purposes, we may also request information concerning your event attendance, preferences, interests, waiver status, or other information needed to administer memberships, community features, and related experiences. Please note that it is always your choice whether to provide us with information about yourself. Please do not do so unless you consent to our Terms of Use, including this Privacy Policy. You must not submit information about any other person without their explicit prior written consent. By submitting information about another person, you hereby represent and warrant to us that you have obtained such person’s express consent, including their acknowledgment and acceptance of this Privacy Policy and our Terms of Use.

We use the information you provide to us in order to operate, maintain and provide the Service to you, including for the purpose of communicating with you, verifying that you are eligible to access and use the Service, creating and administering your account or membership, facilitating membership enrollment, renewals, purchases, event registration, waitlists, community participation, affiliate coordination related to Nuevo Agave experiences or collaborations, conducting internal research and analysis about the Service and the Site, and processing payments for services rendered. If you register for a membership, event, mailing list, or other offering and you engage our memberships, products, or services, we may also keep records of the transactions, registrations, communications, attendance, support requests, and related service history in order to provide ongoing support, administer benefits, improve the user experience, and maintain appropriate business records.

Information we collect for payment processing: We (or our third-party service providers) also collect certain information from members, customers, and other Users that is necessary to provide the Service. For example, in order to process payments for memberships, event registrations, merchandise, or other offerings, our members, customers, and other Users may be asked to provide our third-party payment processor, Stripe, with credit card, debit card, bank account, or other payment information, and they may also be asked to provide billing addresses and other payment-related details. We generally do not store full payment card numbers on our own servers, but we may receive limited payment-related information such as payment status, card type, partial card details, billing ZIP code, and transaction identifiers.

Retaining or discarding your information: We retain your information in accordance with our data retention policy and applicable laws. Personal data is retained for as long as your account remains active and for up to 24 months after account closure for user accounts, up to 7 years for financial records, and up to 3 years for communications, unless a longer period is required or permitted by law, needed for dispute resolution, fraud prevention, enforcement of our agreements, tax or accounting purposes, or legitimate business operations. You should maintain your own records of any information submitted to us.

Legal basis for processing: Where applicable under laws such as GDPR, UK GDPR, or similar legal-basis requirements, we process your personal information based on one or more of the following legal grounds: (1) your consent; (2) contractual necessity (i.e., processing that is necessary for the performance of a contract with you, such as your agreement to use our services); (3) compliance with a legal obligation; and (4) our legitimate interests, provided that such processing does not outweigh your rights and freedoms. We may also process your personal information where necessary to protect your vital interests or those of another person.

Information we collect: We collect various categories of personal information from you and third parties. This includes, but is not limited to: contact information, account and membership information, billing and transaction information, event registration information, communications content, device information, browser information, IP address, approximate location inferred from IP address, usage data, cookie and analytics data, social media information if you engage with us through social platforms, and any other information you choose to provide. We also collect analytics data and log file information as detailed below.

Analytics information: We may directly collect analytics data (such as page views, session duration, bounce rates, device information, browser type, IP address, referral sources, and user interaction metrics), or use third-party analytics tools, including as mentioned in the Cookies Consent tool, to help us measure traffic and usage trends for the Service and Site. These tools collect information sent by your browser or device, including the pages you visit and other information that assists us in improving the Service and Site. We may collect and use this analytics information in aggregate or de-identified form, and in some cases in identifiable form as reasonably necessary for site administration, fraud prevention, debugging, customer support, and improving user experience.

Location Information: When you visit our website or interact with our emails, content, or online services, we may infer your approximate location from your IP address or similar technical information in order to assist in providing you with relevant services, fraud prevention, security monitoring, regional compliance handling, and location-relevant content. We will not share precise location information with third parties, without your consent or affirmative choice to share your location. You can limit certain location-related collection through your device, browser, or network settings at any time.

Use of certain service type information we collect about you: We use or may use cookies, log files, web beacons (clear gifs), and device identifier information (each described further below). You can manage your cookie preferences through your browser settings and, where available, through our Cookie Management Tool to accept or reject non-essential cookies. We use these technologies to: (a) provide, secure, monitor, and improve the effectiveness of our Service and Site; (b) remember preferences; (c) support login, checkout, and membership functionality; (d) monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns; (e) measure communications performance; and (f) diagnose or fix technology problems.

Clear gifs/web beacons information: When you use the Service, we may employ clear gifs (also known as web beacons) which are used to anonymously or pseudonymously track the online usage patterns of our users. In addition, we may also use clear gifs in HTML-based emails sent to our users, including transactional or membership communications delivered through Amazon Web Services or related email infrastructure, to track which emails are opened and which links are clicked by recipients, subject to applicable law. The information allows for more accurate reporting and improvement of the Service.

Device identifiers: When you access the Service by or through a mobile device (including smart phones or tablets), we may access, collect, monitor or remotely store one or more “device identifiers,” such as a universally unique identifier (“UUID”). Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your device. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by Conmigo. A device identifier may convey information to us about how you browse and use the Service. A device identifier may remain persistently on your device to enhance your navigation through the Service. Some features of the Service may not function properly if use or availability of device identifiers is impaired or disabled.

Commercial and marketing communications: You may receive communications from Conmigo in connection with the Service and Site. Communications could include contracts, notices, records, membership-related messages, event-related messages, purchase confirmations, transactional emails, newsletters, promotional messages, and other written communications. By using this Site or the Service, you consent to receive such communications electronically where permitted by law. Conmigo is not responsible for any automatic filtering you or your network provider may apply to email communications that we send to the email address you provide us. Further, by using this Site and registering for an account, joining a list, or making a purchase, you consent to receive electronic communications for all notices required by law or regulation to be received in paper written form, to the extent legally permitted. You may not opt out of Service-related communications (e.g., purchase and billing confirmations and reminders, changes/updates to features of the Service, membership administration messages, event logistics, and technical and security notices).

You can choose to stop receiving promotional email communications from us by clicking on the “unsubscribe” link provided in such communications. We make every effort to promptly process all unsubscribe requests. Conmigo still reserves the right, in our sole discretion, to communicate with you via postal mail, courier, telephone, or other non-electronic communication methods using the address or contact information under which your account is registered. For this reason, it is important that you keep all contact information up to date, including your physical address, mailing address, and electronic mail address.

You may withdraw your consent to receive electronic communications, by mailing written notice requesting withdrawal of consent to receive electronic notices to Conmigo Collective LLC, Attn: Privacy, at our mailing address on file and provided upon request. Should you withdraw, you will no longer be able to use the Service. Such withdrawal will not apply to any communications sent by us prior to our receipt of your notice of withdrawal.

2. SHARING AND VISIBILITY OF YOUR INFORMATION

We will not rent or sell your information to third parties outside Conmigo and its group companies (including any parent, subsidiaries and affiliates) without your consent, except as noted below.

Who we may share your information with: We may share your information with third parties to the extent necessary for the purpose of providing the Service. This may include sharing contact information, account information, transaction information, event registration information, technical data, communications data, and other information reasonably necessary for the functioning of the Service, and information needed to process memberships, purchases, event registrations, support requests, or payments for services. For example, we may share information that you provide to us with service providers and business partners such as Stripe, Amazon Web Services, hosting providers, website developers, analytics providers, email and communications vendors, customer support tools, professional advisors, payment processors, social media or marketing platforms, event operators, waiver administrators, insurers, and, where relevant to a specific experience or collaboration, Nuevo Agave or related partners, for the purpose of verifying the accuracy of the information you provide or to facilitate memberships, communications, event administration, purchases, affiliate coordination, or related services on your behalf. Access to your information by these third parties will be limited to what is reasonably necessary to enable us to deliver, or facilitate our delivery of, the Service.

Your user profile: If the Service includes profile, directory, community, or member-facing features, other users may have access to the information you choose to display through those features. You may have the ability to determine which information about you is publicly displayed, member-visible, or kept private, depending on the functionality we make available.

What happens in the event of a change of control: We may sell/divest/transfer Conmigo or any of its holding companies (including any shares in Conmigo or any of its holding companies), or any combination of its products, services, assets or businesses. Your information such as your name and email address and other user information related to the Service may be among the items sold or otherwise transferred in these types of transactions. We may also sell, assign or otherwise transfer such information in the course of corporate divestitures, mergers, acquisitions, bankruptcies, dissolutions, reorganizations, liquidations, and other similar transactions or proceedings involving all or a portion of Conmigo or any of its holding companies. You acknowledge and agree that your personal data may be transferred in connection with any of the aforementioned events, subject to applicable law and appropriate safeguards for data protection. We will notify users of any such transfer and provide details about the new data controller in accordance with applicable privacy laws.

Instances where we are required to share your information: Conmigo will disclose your information if we reasonably believe that such action is necessary to (a) comply with the law (including any subpoena, court order, or discovery request) and the requests of law enforcement; (b) to enforce our Terms of Use (including this Privacy Policy) or to protect the security or integrity of our Service; or (c) to exercise or protect the rights, property, or personal safety of Conmigo, our users or others.

Sharing certain service type information we collect about you: We may share certain service type information, including information obtained through tools such as cookies, log files, device identifiers and clear gifs (such as usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with our third-party business partners for the purposes described in the section above entitled "How We Collect and Use Information About You." Location of Storage and Processing: Our website is hosted on servers located in the United States, including infrastructure provided through Amazon Web Services and other service providers we may use from time to time. Our website is intended for use in the United States and has been designed with a U.S.-based audience in mind. Your information collected through the Service will be stored and processed in the United States and in other jurisdictions where our service providers operate, as applicable. Conmigo may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders to other countries or jurisdictions around the world, subject to appropriate safeguards and in compliance with applicable laws.

Additional Clarity for International Users: If you are a user accessing Conmigo's website from outside of the United States, please note that you are transferring your personal data to the United States and other processing locations used by our service providers, which may not have the same data protection laws (governing personal data collection, use and disclosure) as your jurisdiction. However, no security system is impenetrable, and Conmigo cannot ensure or warrant the absolute security of any information you transmit to Conmigo or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed by unauthorized parties. While Conmigo implements reasonable security measures, to the fullest extent permitted by applicable law, Conmigo disclaims liability for any damages, losses or claims of any kind relating to any information that you provide to us or others through this Site, except to the extent such disclaimer is prohibited by law. 4. COMPLIANCE WITH PRIVACY LAWS AND DATA SUBJECT RIGHTS

Data Security and Breach Notification: We maintain a data security program and implement reasonable administrative, technical, and physical safeguards appropriate to the nature of the personal information we process. Data Retention: We retain personal information only as long as necessary for the purposes outlined in this Privacy Policy, for the duration of any active account, membership, transaction, or relationship, or as required or permitted by law. Upon request or account termination, we may delete, anonymize, or de-identify personal information, except where retention is required for legal compliance, dispute resolution, security, fraud prevention, tax or accounting purposes, recordkeeping, or enforcement of our agreements.

International Privacy Rights: If and to the extent Conmigo offers goods or services to individuals in, or otherwise becomes subject to the privacy laws of, the European Economic Area, United Kingdom, Switzerland, or similar jurisdictions, we will process personal data in accordance with applicable lawful bases, which may include consent, contractual necessity, legal obligation, and legitimate interests. 5. CHILDREN'S PRIVACY AND AGE RESTRICTIONS

Conmigo does not knowingly collect or solicit any information from anyone under the age of 18 or knowingly allow such persons to register as users of this Site. The Service and Site and its content are not directed at children under the age of 18. No person under the age of 18 may use the Service. Do not provide us with any information for any reason unless you are at least 18 years of age, and do not provide us with any information about any other person who is under the age of 13. We will review this page periodically and update the Effective Date when changes are made. Your continued use of the Service after the effective date of such changes constitutes acceptance of the updated Privacy Policy.
